Here is the statement for the Australian Minister of Immigration Chris Evans.

Migration reforms to deliver Australia’s skills needs

Monday, 8 February 2010

The Rudd Government is reforming the permanent skilled migration program to ensure it is more responsive to the needs of industry and employers and better addresses the nation’s future skill needs.

The reforms will deliver a demand rather than a supply driven skilled migration program that meets the needs of the economy in sectors and regions where there are shortages of highly skilled workers, such as healthcare, engineering and mining. The major reforms to the skilled migration program are:

20 000 would-be migrants will have their applications cancelled and receive a refund.

All offshore General Skilled Migration applications lodged before 1 September 2007 will have their applications withdrawn. These are people who applied overseas under easier standards, including lower English language skills and a less rigorous work experience requirement. It is expected about 20 000 people fall into this category. The department will refund their visa application charge at an estimated cost of $14 million. Average applications cost between $1500 and $2000 and most contain more than one person.

The list of occupations in demand will be tightened so only highly skilled migrants will be eligible to apply for independent skilled migration visas.

The wide-ranging Migration Occupations in Demand List (MODL) will be revoked immediately. The list is outdated and contains 106 occupations, many of which are less-skilled and no longer in demand. A new and more targeted Skilled Occupations List (SOL) will be developed by the independent body, Skills Australia, and reviewed annually. It will be introduced mid-year and focus on high value professions and trades. The Critical Skills List introduced at the beginning of 2009 which identified occupations in critical demand at the height of the global financial crisis will also be phased out.

The points test used to assess migrants will be reviewed to ensure it selects the best and brightest.

Potential migrants gain points based on their qualifications, skills and experience, and proficiency in English. The current points test puts an overseas student with a short-term vocational qualification gained in Australia ahead of a Harvard-educated environmental scientist. A review of the points test used to assess General Skilled Migration applicants will consider issues including whether some occupations should warrant more points than others, whether sufficient points are awarded for work experience and excellence in English, and whether there should be points for qualifications obtained from overseas universities. The review will report to Government later this year.

Certain occupations may be capped to ensure skill needs are met across the board.

Amendments to the Migration Act will be introduced this year to give the Minister the power to set the maximum number of visas that may be granted to applicants in any one occupation if need be. This will ensure that the Skilled Migration Program is not dominated by a handful of occupations.

Development of state and territory-specific migration plans.

Individual state and territory migration plans will be developed so they can prioritise skilled migrants of their own choosing. This recognises that each state and territory has different skills requirements. For example, Western Australia may have a shortage of mining engineers while Victoria may have a requirement for more architects. Under the new priority processing arrangements, migrants nominated by a state and territory government under their State Migration Plan will be processed ahead of applications for independent skilled migration.

The Minister for Immigration and Citizenship, Senator Chris Evans, said the new arrangements will give first priority to skilled migrants who have a job to go to with an Australian employer. For those who don’t have an Australian employer willing to sponsor them, the bar is being raised.

‘There are plenty of occupations where there is an adequate supply of young Australians coming through our schools, TAFE colleges and universities to take up new job opportunities. They must be given the opportunity to fill these vacancies first,’ Senator Evans said.

‘But there are some occupations where there will be high demand for skills. Hospitals can’t go without nurses, country towns can’t do without a local GP and the resources sector increasingly needs skills.

‘These latest changes will continue reforms already implemented by the government and result in a more demand-driven skilled migration program that attracts highly skilled migrants to Australia to work in areas of critical need.’

The government recognises that the changes will affect some overseas students currently in Australia intending to apply for permanent residence.

Those international students who hold a vocational, higher education or postgraduate student visa will still be able to apply for a permanent visa if their occupation is on the new Skilled Occupations List. If their occupation is not on the new SOL, they will have until 31 December 2012 to apply for a temporary skilled graduate visa on completion of their studies which will enable them to spend up to 18 months in Australia to acquire work experience and seek sponsorship from an employer.

The changes will in no way impact on international students coming to Australia to gain a legitimate qualification and then return home.

    Eeman – You need to talk with a registered migration agent about this. I think it just means your application slows down due to priority being given to others.

    Suhas – No one knows what the new basis wil be. All you can do is continue on your present path. Australia is still short of experienced engineers, so it is unlikely that engineers will be excluded from any new priority list. One trend that occurring is priority is being given to people who have job offers. So look for sponsorship options.

    Hassan – Your visa priority status will not have changed as the new critical skills list of March 2010 includes the same specialisations as were included before. The only difference is that the CSL referred to the MODL before, but now the occupations are listed in the CSL.

    Sam – If your occupation is not on the current list, whatever list, it does not matter who the assessing authority is. Qualifications assessement is only a step in the migration process. You can be qualified in your occupation, but if Australia is not accepting people you will not ne considered for a skilled migrant visa. You will need to look at other visa types.

    Anyone help clear up my confusion please? I was granted a 485 Graduate visa in July 2009 with a nominated occupation in the SOL. I will complete my Master’s degree this July which gains me the crucial extra 10 points for applying PR. I always thought the 485 visa was to buy me time, during which I obtain skills and experience necessary to qualify for immigration. However the new SOL won’t include my occupation, Will changes to the List affect a holder of 485 visa at all? Thanks.

Is there any relaxation for age or I have to undertake Professional Year for obtaining 10 points those I lost in age under new SOL list for getting PR?or new SOL has decreased points for my degree from 60 to 50?

    My question is I will be graduated in January 2011 in Masters in Accounting.
    I’m an Engineer in electronics but worked as a recruitment consultant for 5.5 years. I would like to start Business (planned my future well) n this made me to get into Accounting. Now that I have good understanding of Technology and Business (with accounting knowledge). Just wanted to check with you whether Accounting will be there in demand list or SOL atleast… I’m scared that my efforts is going to be wasted in studying Masters. The problem is time (spent 2 yrs priceless time).

    Based on the new rules again I have change my plan and future career path…

    I doing Professional Year at the moment and will be compeleted by the end of Aug. As my understanding, I should be stil eligilble to appy for GSM 885, right? but what about the priority of processing, I am an accounting graduate, on the CSL. Many PY graduates granted PR v soon after they finished PY. By the time i finish PY, CSL will be replaced by SOL. does that mean I will have not priority at all and have to wait for years?

I wanted to ask you and my case is that I recently graduated from Monash University (Malaysia campus) with a bachelors of Arts in Communications (media studies). I am now employed as an English copywriter with a well known ad-agency. Is copy writing still valid as an occupation under the new SOL? If yes,
    Would gaining 3-4 years of experience (instead of 2 years) in the field be easier for me to migrate to Australia and get a PR?
    I also have my first cousin and sister as sponsors in Sydney. Would that give me extra points?

    Sarah – Certainly a higher skill level will increase your chances if your occupation remains on the SOL. I doubt if it is an occupation in demand. Go to the Department of Immigration and Citizenship (DIAC) web site and get the booklets on general skilled migration and family reunion from the Publications page. These will give you more detailed information than I can provide here. family ties do not help for a skilled visa application. They are a separate category.

    Harsh – No one knows what will happen with the new Skilled Occupation List in June. Australia is short of engineers and health professionals, particularly in areas outside the capital cities. It is likely that occupations in these fields are likely to remain in demand.

    Hi just wondering, what would happen to the students who applied for tr ( 485) visa after Feb 8? I know anyone applying before that date is safe. There is news one might need to do CPA or CA to be able to migrate with accounting degree, and master would not suffice, is that true? Even if the rule of doing masters comes true, would it be required to be done full-time or part- time? Currently, professional year could have added extra 10 points, is this going to be scrapped? Also, what are the chances unlimited work rights of Skilled Graduate Visa would be removed or of their dependents?

    I’ve almost finished my Master’s in Health Administration from Melbourne this year and will apply for a TR asap. I will try my level best to apply before 30th June 2010 (based on the old list). The new list will be operational from 1st July 2010. However, there are quite a few speculations that the new list may apply from 1st January 2011 since several international students who have joined this year could be seriousl affected by the new changes. My occupation i.e. Health and Welfare Service Managers does feature in the draft, but I have no idea how many points exactly is this going to be. BTW, most of the occupations that appear in the draft would most likely be there in the new list along with certain occupations that have been omitted such as journalism, HR, Marketing, Sales, animation and quite a few. This will be really bad for new internaitonal students or those who’ve been here since 2009 or 2010 and they will find it extremely hard to find jobs in their respective fields after the implementation of the new SOL.

    Vishwa – This course does not change your occupation for migration. You will still be an electronics engineer and will be assessed on your undergraduate qualification. The course will get you additional GSM points as a course from an Australian university.
    Try and separate your education desires from you immigration intentions. Personally I would wait on doing the course so that you are not paying as a foreign student.
    Courses are not on the SOL list. The SOL list is for occupations. Who knows what will happen, but engineering is likely to stay on the list. Your best move is to get a job and be sponsored by an employer.

I plan to do MAster in Electrical Engineering at the university of sydney with an option of moving into a PHD at the end of the Master course. I want to know whether I can apply for PR after completion of the MAster degree? How long does the whole process take? Does having an Australian Qualification gives you more points? Do you still think that Electrical engineering will be in the new SOL list?

    Diren – Separate your education plans from any thoughts of migration. If you are doing the course purely for migration, forget it. The rules are changing and will keep changing as Australian demands for different occupations change. You already are highly likely to be able to be accredited as a professional engineer by doing a Competency Demonstration Report (CDR) for Engineers Australia now. It is likely that electrical engineering will remain an occupation in demand and be on the new SOL to be issued on April 20. The whole points system is under review. The existing additional points for Australian qualifications may disappear.

    Wait until the new guidelines come out mid year before committing yourself to anything (especially spending money). Go to our Engineering Careers Advice page read the FAQs and follow the links to fully inform yourself.

    If you do a course in Australian, be aware you may not be able to get PR at the end and may have to leave Australia if conditions change. Many people are being caught now by the current changes.

    It is likely that getting more work experience in your own country may be more valuable than higher education. Australia is seeking experienced workers. As a graduate you are competing against young Australians who will be given priority.

Once it is done, I can continue my higher education (as I’m a typical bookworm). I might be eligible also for domestic fees…..I wanted to know whether there are any engineering exams that the board of engineers Australia conduct for foreign degrees jusk like in UK system? I want to have an Australian qualification on my CV.

    Dear sir, you mentioned that the new list is arriving on 20th April 2010. Can you please reconfirm this information as most other places (including DIAC’s website) indicate that the official release date for the list is 30th April 2010?

    I will be finishing my Masters in Health Admin. this year. However, I am only doing one unit as I was exempted by the uni for 3 units for this course. This is my final semester and I officially finish by 26th April 2010. I am trying my level best to get a course completion certificate by 27th or 28th April 2010. In addition, I’ve seen my occupation as already been listed on the draft SOL (1342 – Health and welfare services managers). Is it possible that I can lodge my TR before the new list is finally implemented in mid-2010? Another point that I want clarification is if I apply before mid-2010, will I be assessed on the basis of the previous list or new list? Please let me know as I have to apply for my TR. And I’m keeping my fingers crossed for my occupation i.e. Health and welfare service managers to remain on the new SOL. Thank you!

    Stella – Migration is not a good path for making a career change as you will have trouble getting a job without relevant work experience to your qualifications. I do not think anyone can give sound advice at the moment as the migration system is about to change. Your first choice should always be to get a job. IF I was you I would wait until you see the new SOL and the new points test. talk to a registered migration agent.

    Vishwa – All you may get extra is the points for an Australian higher degree. You are still an electronics engineer. An MBA without work experience is not highly regarded when applying for a job. As things may change i would not make such a big decision until you see the new guidelines.
    I repeat -separate your education and immigration goals.

    Satbir – This is all a gamble until the new SOL is released. Wait until the new list is out. Specialist IT skills are likely to be highlighted as they are in the current CSL. Ensure you specialise in areas listed in the new SOL.

    This introduction to abolish the MODL and curb migrants has definately been both good and bad for the country, yet as this all unfolds, the key objective here would be for anyone trying to migrate to Oz, (a) get a sponsored job, effectively that may would allow a speedy process and (b) wait for the list (SOL). according to some migrant companies the list could drop from 106 catagories down to 4 catagories, which is a 95% scrapping of skilled migrants, recent booming in the economy has sparked off anaylists to say that the country could fall short of many skills in the next 3 months, the only thing left to do is wait till april 30.

    I was in Sydney in January with my wife and we decided to move there permanently. Unfortuntaly, despite that my wife and I are really skilled personnel consultants, the SOL calculation was really on the edge and subject to change.
    I am surfing all the web to find news and just found here the information about the 30th april release.
    I hope it is real. I will be 40 soon and I need to apply before that day!.

    I hold a Beng (Hons) degree holder in Electrical & Electronic Engineering from a Malaysian university. Given the fact that Malaysia has gained full recognition & status in the Washington accord, do I still have to go through the Competency Demonstration Report (CDR)? From what I read, I guess it is apparently not required. I just want to confirm.

    Diren – You will not need to do a CDR if the course you have done is included in the list of recognised Malaysian university courses. You need to go to the Washington Accord web site and follow the links to see the courses accredited in Malaysia. This covers university, particular course and course year. if your specific course is not listed you will need to do a CDR.

    I am graduate civil engineer, submitted my CDR in januay 2010 got the approval in april , now the Feb 8 2010 change has affected me as the IELTS score is AVG 7 but not in all modules,for that reason i lost 10 points and now have 110 total points.
    I need your suggestions , should i repeat IELTS for 7+ in all or should i wait for new rules

    Ali – Do both. You do not have any alternative but to wait for the new rules. You should be doing everything you can to improve your English. The better your English is, the better the job you will get. I would not recommend doing a new IELTS test until you see the rules.

    This is Jack from Singapore studying Masters in Accounting here in Australia.
    I noticed that Accounting is there in SOL and will be eligible for PR provided 7 band in IELTS (academic). My question is what if I won’t get 7 in IELTS. Am I eligible for TR (subclass 485 visa).
    Also CPA wants a student to get 7 in order to assess the degree. To apply for TR assessment is required? Please advise what best I can do if I won’t get 7 in IELTS.

    Jack – If you don’t get 7 in the IELTS test, work hard to improve your English until you get it up to standard. It is essential to have good English to get a decent job anyway. There is no easy way round this.

    Amy – Without IELTS 7 you will not be accredited. General skilled migrants are at the end of the queue after sponsored applicants.

    Khan – You must have IELTS 7 in all categories to apply for accreditation. Without this you will struggle to get a job any way.

    Jacqueline – You need to be able to meet the skills recognition requirements for an accounting occupation listed in the new SOL. The occupation definition is given in the ANZSCO definition. The accreditation requirements can be found on the Australian Skills Recognition Information (ASRI)) web page. Type immi asri in your browser and follow the links.

    I have completed my Diploma of Business Marketing which was of ten months and no points for PR. Currently doing Diploma of Community Welfare Work, which I have started in the beginning of this year and will complete it by November ’11. I had a look at the new SOL, and it still has the occupation of a social worker there, does that link up to diploma of community welfare? If not, what do you reckon my options are with this diploma?

    Would really appreciate if you could help me out with figuring that out.

    Confused – You need to go to the Australian Skills Recognition Information (ASRI)web site . That will provide links to the qualification assessment body for each occupation. Go to that site and see what the requirements are foran occupation you are trained for. Training for different occupations will cost you a lot of money and may not help in the end. Work out what career you want first.

Yes the new list talks about specialise parts in IT like programmer, system analyst ………so can I consider my course still in the new list……..waiting for your reply.

    Samar – You do not gain entry through course. You need to meet the eleigibility requirements for specific occupations which ar required in Australia. So you willnly be eligible for general skilled migration if you can meet the requirements of the particular IT skills listed in the SOL. The best apth is to seek sponsorship.

    I request your help for my immigration to Australia. I am an Electronics Engineer (4 yrs course) from India and have an experience of 4 years. I am under 30 and would like to immigrate to Australia for a permanent residence.

    I have got struck because of my profession and temporary hold of new Visa applications.

    I am into sales of Electronics Components for last few years. I am afraid to proceed with my visa application because of the assessment with IEA. As per IEA site, applicant should have a CDR with technical experiences, which is not available much in my job. I request you to advice whether I will be able to migrate Australia with experience of Electronic component sales. Can I use my experiences of my final year project to show my knowledge? Please advice.

    Also please advice present job opportunities at Australia for Sales / Marketing (Electronics).

    I have not processed Visa application yet. I also request you to advice, whether I should wait till 1 July 2010 to know the new announcements of Australia Government on Immigration. Will there be any changes in pass point systems / SOL / CSL ? Please advice and help..

    SS – You cannot apply for general skilled migration at the moment even if you wanted to. You need to wait and see what the new requirements will be. They are likely to change a lot. You can write career episodes from your undergraduate years to demonstrate engineering competencies. You can pick out particular parts of your work where you have been involved in engineering activities for a CER. With weak experience you will struggle to get a job in Australia. Australia is after experienced engineers.

    I just received my sucessful TRA results(4th June) as a Genaral Communication Tradesperson 4316-11. But this occupation is not in the new SOL. I think i cannot apply for GSM with this occupation. but there are two similer occupations in the new SOL those are Radio communication Technician & Telecommunication Technical Officer. I informed to TRA this issue,but they asked me to contact DIAC directly regarding this matter, but I could’n find any email address of DIAC. let me know if you know any email contact there and what should I do with this issue? Is it possible to replace this occupation with new SOL -Telecommunication Technical office or Radio Communication Technician?
